Rivers APC in shadow boxing in Abuja, PH courts to select governor
* Amaechi group hangs on Abuja courts to deal blows to Magnus Abe’s plans
* Abe hopes on PH court to upturn congresses
By Codratus Godson
Both camps in the deteriorating crisis in the Rivers State chapter of the All Progressives Congress (APC) have entered into what many call ‘shadow-boxing’ in three courts in Nigeria, from Port Harcourt to Abuja.
Now, Chief Eze Chukwuemeka Eze, an ally of the Minister of Transportation, says his group have just caught an ally of their latest detractor, Senator Magnus Abe, boasting of a concluded outcome of the case in a PH court trying to stop the Amaechi effort to install the party’s governorship candidate. The Abe camp has not responded.
We have caught you – Eze
Eze, in a press statement on Sunday noted that the judgement to be delivered by Hon justice Chiwendu Nworgu of the State High Court in Port Harcourt the Rivers State capital in the suit filed by Abe and his faction of APC in Rivers State challenging the congresses that gave birth to the Chief Ojukaye led APC has been compromised if the exposure and boasting of the Legislative Aide Kennedy Friday to Senator Abe is anything to go by.
Eze quoted the Legislative Aide to Senator Abe as boasting in the midst of Abe’s supporters on Sunday thus: “By tomorrow, Rt. Hon. Chibuike Rotimi Amaechi the Minister of Transportation and fake Leader of APC in Rivers State will be thought a political lesson that will end his political career in Nigeria. We have prepared the judgement to be delivered tomorrow by Hon justice Chiwendu Nworgu which we have delivered to him at his residence situated in Port Harcourt. So far we are concerned, Amaechi is a goner and Gov. Wike is a star. Let us therefore drink and celebrate the continuation of Wike as Governor of Rivers State till 2023 when he will handover to Abe as agreed”
Eze lamented the demise of judicial integrity but said the boasting by this legislative aide was uncalled for as he said God would not allow darkness to prevail over the light.
In conclusion, Eze thanked the said Kennedy Friday for mistakingly exposing the plot. He urged all members of APC in Rivers State not to be deterred on the arranged judgment because the only way the Ojukaye led Excos can be invalidated will be through an order of a Higher Court, which is either Court of Appeal or Supreme Court and not through the State Court presided over by Justice Nworgu which is of coordinate jurisdiction to the Abuja High Court Presided over By Hon. Justice A.O Musa which validated the Election of Ojukaye led Excos
Abe’s Abuja court attempt falls flat – APC publicist
Moves by some loyalists of Sen. Magnus Abe to vacate the perpetual injunction that was granted in favour of the Ojukaye Flag-Amachree-led Rivers State Executive Committee (SEC) of APC on September 4, 2018 by an Abuja High Court have crashed, so declared the Rivers State Publicity Secretary, Chris Finebone
He said: In a ruling delivered by the Presiding Judge, His Lordship, Justice H.B. Yusuf of an Abuja High Court holding at Maitama on 20th September, 2018, the court declined to rule on a Suit No: FCT/HC/CV/2705/18 filed by the 23 claimants. The judge ruled that: “Based on all that I have said, it is my honest view that it is unwise and unprofitable to make further progress in this case, but rather to stay further proceedings pending the decision of the Court of Appeal. This case is accordingly adjourned sine die.”
While H.A. Bello Esq appeared for the claimants, Oluwole Adaja Esq put up appearance for the 1st Defendants (Ojukaye-led EXCO) and O.H. Arono Esq for the 2nd set of Defendants (APC and the National Chairman).
It would be recalled that Abuja High Court 14 presided over by His Lordship, Hon. Justice A. O. Musa, on Tuesday, September 4, 2018 granted an Order of Perpetual Injunction restraining the APC and the national chairman, Comrade Adams Oshiomhole (1st and 2nd Defendants) from ‘tampering with the mandates of the elected Officials/Delegates elected at the 1st Defendant’s Ward, Local Government and State Congresses in Rivers State on May 19, 20 and 21, 2018 respectively, either by nullifying, removing or in any way refusing to give effect to the outcome of the said congresses or by purporting to conduct another congress in respect of Rivers State.”
With the ruling by Hon Yusuf to adjourn the matter sine die, all pending appeals arising from the initial ruling by Court 14 presided by Hon. Justice Musa will have to be done with before further action can continue on the matter. (Attached is the ruling by Hon. Justice H.B. Yusuf of the Abuja High Court holding at Maitama on 20/9/2018).
They plan to malign me – Abe
Frontline governorship aspirant on the platform of the APC, Senator Magnus Ngei Abe, has said that there is an orchestrated plot by some individuals to smear his reputation before national leadership of the party.
Abe, who spoke in at Ahoada temporary stadium, Ahoada East Local Government Area of Rivers State, said any campaign of calumny against him will fail.
Abe, who is the Senator representing Rivers South East Senatorial District in the National Assembly, said he is interested in occupying the State Government House in 2019 because he has a clear plan to develop the state.
He stated that it was unfortunate for politicians who do not want him to actualize his ambition of becoming governor to resort to smear campaign in a bid to bring him down.
He said, “There is an orchestrated campaign to bring me down and paint me black before the national leadership of our party. The campaign is sponsored and paid for by some people because we have looked at what is happening in the state and said that we have solution”.
“Those who do not want that our decision to run have come up with a campaign of hate before our party leadership to end our campaign before we even start,” Senator Abe said.
He, however urged his supporters to ignore any hate campaign aimed at tarnishing his reputation in the interest of the party and Rivers State at large, adding that what the state need now is unity and not politics of bitterness.
Don’t be jittery – Amaechi camp tells members
As the broke Monday, September 24, 2018, the day a Port Harcourt court is to delive judgment on a sensitive case that could sweep the powers of Amaechi to produce the APC candidate, the camp is being calmed ddown. This statement flashed through: “Don’t panic or be jittery as the arranged judgement to be delivered today by Hon. Justice Nworgu has already been made public even before the time. All is targeting at removing Ojukaiye Flag Amachree –led Excos by all means vased on the collaborations of….
Rivers APC has no business with any judgment coming from Justice Nworgu as it will not have any effect whatsoever, since it’s essence is to diminish and tarnish the hard earned image of our leader, Rt. Hon. Chibuike Rotimi Amaechi.
For any judgment to be said to have any effect, it must come from a court of competent jurisdiction or a higher court.
In the case of Rivers State APC, the only judgment that can set aside or invalidate Ojukaye exco must be an order of Court of Appeal or Supreme Court as an Abuja High Court pesided over by Hon Justice A.O Musa has already validated it.
Anything coming from the PH judge will only have effect at the home of those that procured it and not APC.
